Terms and conditions of use
This is a translation of the Spanish original. Should the two ever differ, the Spanish version is the one that applies. If anything here matters to your decision and you would like it explained, write to us.
These terms govern the use of Audio Journey, both the mobile app and this website. By accepting them you are bound by them. If you do not agree, you may not use the service.
1. What this service is
Audio Journey is a platform where some users —creators— publish Audio Tours: routes made up of places, each with coordinates and its own audio. Other users —travellers— hire them and listen on location through the mobile app, which plays each audio automatically as they enter the radius of the matching place.
The app works offline once the package has been downloaded. A few specific features do need internet, and they say so at the time.
2. Account
Using the service requires signing in with a Google account with a verified email address. We do not create or store passwords of our own.
You are responsible for what happens under your account. If you notice activity you do not recognise, tell us.
3. Hiring Audio Tours
Hiring an Audio Tour gives you the right to listen to it for the number of days shown on its listing, counted from the moment payment is confirmed. It is temporary access, not a permanent purchase.
Price and duration are frozen at the moment of payment: if the creator changes them later, your contract is unaffected.
Once the period ends, the Audio Tour stops playing and you may hire it again at the price in force then.
Payments are processed by Stripe. We never see or store your card details.
4. Downloading and using the content
Packages are downloaded from the app through a single-use link tied to your contract. That link expires and cannot be reused.
The content is for your personal use. You may not copy it, redistribute it, resell it, extract the audio files or publish them anywhere else.
5. If you are a creator
Publishing Audio Tours requires prior approval. We review every request by hand and may reject it, or withdraw the permission later, stating the reason.
By publishing you warrant that you hold the rights to everything you upload: audio, text, images and coordinates. Any third-party claim over that material is your responsibility.
If your permission is withdrawn, your Audio Tours are not pulled down at once: anyone who has hired them keeps access until their contract expires. What you lose is the ability to create and edit.
6. Revenue share and payouts
For each sale you receive the percentage in force at the moment of the sale, which is frozen in that record. Changing the share does not alter what has already been sold.
Payouts are made through Stripe Connect to the account you connect. Without a connected and verified account we cannot transfer anything to you.
Stripe's processing fees come out of the platform's share, not yours.
7. Synthetic voice
You may narrate your Audio Tours in your own voice, or generate the audio from a script using Google's text-to-speech service.
Generating synthetic voice is a paid feature. The price and the volume it covers appear in the form itself before anything is generated. Nothing is charged up front: the amount accumulates and is deducted from the first payout you receive from your sales.
The text you write to generate the voice is sent to Google to be synthesised. Do not use it for anything you would not want to send to a third party.
8. Automatic playback depends on GPS
The audio is triggered when the device believes it is inside the radius of a stop. That belief depends on GPS accuracy, which varies with terrain, buildings, weather and the phone itself.
An audio may fail to play even though you are standing at the place, or play earlier than expected. We do not guarantee that automatic playback works in every case. You can always play manually any place you have already unlocked.
9. Availability and changes
The service is provided as it is. We may modify it, interrupt it temporarily for maintenance, or stop offering particular features.
If we change these terms substantially, we will ask you to accept them again before you continue using the service.
10. Closing your account
You may close your account at any time by writing to the contact address. We may suspend it if you breach these terms, in particular by redistributing content or publishing material you do not hold the rights to.
